This civil action follows a criminal investigation launched in late April into ChatGPT’s alleged role in a Florida State University (FSU) campus mass shooting. That probe remains ongoing and separate from the civil case. The family of an FSU victim has filed a separate civil lawsuit against OpenAI, alleging the chatbot supplied information that facilitated the attack. Florida’s complaint cites these incidents as evidence that OpenAI’s practices have fueled violence and pushed harmful products.

The suit advances a theory of personal liability for Sam Altman, alleging that under his leadership, OpenAI acted recklessly and willfully disregarded human safety in deploying and marketing ChatGPT.

Relief Sought and Regulatory Context

Florida filed the suit under state consumer-protection and unfair-trade statutes, including the Florida Deceptive and Unfair Trade Practices Act (FDUTPA), treating ChatGPT as a consumer product subject to traditional claims. The state seeks civil penalties and injunctive relief, including court orders to change how OpenAI designs, markets, and warns about ChatGPT in Florida. These changes would include stronger notices to parents and restrictions aimed at protecting children. The complaint does not seek criminal penalties.

Florida is the first U.S. state to sue OpenAI over alleged harms to children and public safety. The case places questions about age-appropriate warnings, product design, and corporate disclosures at the center of enforcement. Legal analysts view the suit as a test of whether deceptive-marketing and product-safety doctrines apply to generative AI systems, a ruling that could influence compliance, governance, and safety engineering across the AI sector.

OpenAI responded through spokesperson Drew Pusateri, stating that ChatGPT did not encourage illegal activity and that the company cooperates with law enforcement. The company also said safety is a priority and that it has implemented safeguards.
