Liquidia Corporation said the settlement with United Therapeutics, announced Oct. 13, 2026, resolves six lawsuits, preserves YUTREPIA’s pulmonary arterial hypertension (PAH) commercialization, and requires sizable scheduled payments while the company seeks a label change.
Settlement Terms and Payments
Liquidia Technologies, a subsidiary of Liquidia, and United Therapeutics executed a global settlement resolving all six pending lawsuits. The agreement requires aggregate payments of $380.7 million across 2026 and 2027.
Liquidia will pay United Therapeutics $175.0 million net within 30 business days of the effective date. An additional $145.4 million will be paid in two equal installments of $72.7 million on or before Jan. 31, 2027, and Apr. 30, 2027. The company will also pay $60.3 million in October 2026 to parties involved in related antitrust litigation. The $175.0 million net payment reflects amounts United Therapeutics previously paid Liquidia to resolve related antitrust claims.
The settlement follows a Sept. 30, 2026, ruling by the U.S. District Court for the District of Delaware that found claims 1 and 14 of U.S. Patent No. 11,826,327 valid and infringed by Liquidia. Liquidia agreed not to appeal. The company also terminated its promotional agreement tied to Treprostinil Injection and will no longer support that product commercially.
The agreement includes mutual releases that are not admissions of liability. These releases become effective only after required payments, court dismissals, and FDA approval of the label change. The parties intend to file dismissals with prejudice covering patent-infringement, trade-secret, contract, and related antitrust matters after the initial payment.
YUTREPIA Access and Financials
The settlement allows Liquidia to continue marketing, selling, and promoting YUTREPIA (treprostinil inhalation powder) for PAH without interruption. The company said, "YUTREPIA will remain available to patients with PAH without disruption."
Liquidia submitted an FDA supplement requesting removal of the pulmonary hypertension associated with interstitial lung disease (PH-ILD) indication from YUTREPIA’s label and said it will no longer promote the product for that use. The label change remains pending FDA approval.
The company reported preliminary, unaudited third-quarter 2026 YUTREPIA net product sales of $222.7 million and cash and cash equivalents of $396.1 million as of Sept. 30, 2026. It expects to fund settlement payments through cash on hand and ongoing YUTREPIA sales.
Liquidia will continue advancing YUTREPIA and the investigational L606 clinical program as previously outlined. The company plans to provide a broader update on its financial position and pipeline priorities during its third-quarter 2026 earnings call in November.
